Terms and Conditions of Sale

These terms and conditions govern orders for POPÃ products, including the Claye, a bottle opener designed for champagne, sparkling wines and sparkling drinks. POPÃ distribution is primarily intended for professional customers: resellers, wine merchants, independent retailers, concept stores, department stores, hospitality businesses and distributors.

1. Seller

The seller is LC Partners, a French simplified joint-stock company (SAS), operating the POPÃ brand and the maison-popa.myshopify.com / maison-popa.eu website.

2. Products

The products offered are bottle openers, presentation accessories, packaging and sales materials associated with the POPÃ brand. Essential product characteristics are shown on product pages, catalogues, quotations or commercial documents sent to the customer.

3. Customers concerned

The POPÃ website and forms are primarily intended for professional customers. When sales are concluded with consumers, mandatory consumer protection rules apply, including pre-contractual information, legal warranties and withdrawal rights.

4. Orders

An order may be placed through the website, commercial exchanges, a quotation or any other method accepted by POPÃ. Any order implies acceptance of these terms and of any specific terms stated in the quotation, invoice or order confirmation.

5. Prices

Prices are stated in euros. For consumer sales, prices are shown including taxes where applicable. For professional sales, prices may be communicated excluding taxes, with applicable taxes, discounts, volume tiers, shipping costs and specific conditions stated separately.

6. Payment

Payment terms are specified during ordering, on the quotation or on the invoice. Accepted payment methods may include online payment, bank transfer or any other method approved by POPÃ. For professional customers, late payment penalties and fixed recovery fees may apply under applicable law.

7. Delivery

Delivery zones, methods, times and costs are communicated before order confirmation or on the quotation. Delivery times are indicative unless expressly guaranteed. The customer must check the parcel on receipt and promptly report any issue to the carrier and to POPÃ.

8. Retention of title

Products remain the property of LC Partners until full payment of the price, fees and taxes. Transfer of risk occurs according to the agreed terms and the rules applicable to the sale concerned.

9. Withdrawal right

For consumers, the legal withdrawal period for distance sales is 14 days from receipt of the product, unless a legal exception applies. Practical terms are detailed on the Returns and Refunds page.

For professional customers, withdrawal rights do not apply automatically unless mandatory rules provide otherwise or a specific written commercial agreement has been made.

10. Legal warranties

When the customer is a consumer, they benefit from applicable legal warranties, including the legal warranty of conformity and the warranty against hidden defects. Professional customers benefit from warranties provided by law and by any agreed specific terms.

11. Liability

LC Partners cannot be held liable for improper use of the product, handling contrary to safety instructions, pointing the bottle toward a person or uncleared area, or damage resulting from misuse. The Claye must be used carefully, on suitable bottles, and in accordance with the instructions for use.

12. Intellectual property

The POPÃ brand, visuals, texts, packaging, models, commercial materials and graphic elements of the site are protected. Any unauthorized reproduction or use is prohibited.

13. Personal data

Data collected through contact requests, quotations, orders or commercial exchanges is processed in accordance with the website Privacy Policy.

14. Disputes

In case of difficulty, the customer is invited to contact POPÃ at contact@maison-popa.eu to seek an amicable solution. For consumers, consumer mediation details must be completed before publication where applicable. Failing amicable resolution, disputes will be submitted to the competent courts under applicable rules.
